The terms we work to.
The terms for using this website and for any project we take on with you. Questions go to sales@orbiting.online. Last updated 30 September 2026.
01About these terms
In these terms, “Orbiting Online”, “we” and “us” mean the business trading as Orbiting Online in the United Kingdom, and “you” means the business we are working with or the person using this website.
These terms apply to your use of this website and to any website project we agree with you. Booking a project means you accept them. If the written confirmation for your project says something different to these terms, the written confirmation applies.
02Who we work with
Our services are for businesses. By booking a project you confirm that you are acting for the purposes of your trade, business or profession, and that you have authority to agree these terms on behalf of the business named in your booking.
03Starting a project
A project begins once we have confirmed its scope and price to you in writing (email is enough) and your deposit has been received. The price is the one in that confirmation. For The Site, that is the fixed price shown on this website; for The Custom Build, it is the price quoted to you after our call.
The scope is what the written confirmation describes. Anything outside it is extra work, which we will price separately and only carry out if you agree.
04Timing
For The Site, your site is live in seven days, counted from your completed questionnaire. A Custom Build runs to the timeline agreed in its written confirmation.
Timelines depend on the questionnaire being complete and on us being able to reach you if something essential is unclear. If a delay is caused by information we are waiting for, by a third party such as a domain registrar or hosting provider, or by events outside our reasonable control, the timeline moves on by the length of that delay.
05The deposit
The deposit comes back in full, no questions and no reason needed, any time before you approve the finished site.
To ask for it back, email accounts@orbiting.online. We return it to the account it was paid from. Once you have approved the finished site, the deposit forms part of the price and is no longer returnable.
06Changes and approval
You will see the finished site on a live preview link before anything else is due. One round of changes is included: tell us everything you would like changed in one go, and we will make those changes within the agreed scope. Further rounds, or changes outside the scope, are extra work.
You approve the site by telling us so in writing. Approval confirms that you are happy with the site as built, including the words on it.
07Payment and handover
The balance is due when you approve the site. Handover takes place once the balance has been paid in full.
You own everything at handover: the code, the hosting and the domain, in your own accounts. Nothing renews. Ownership of the work we have created for you passes to you on full payment. Until then, all of it remains ours and is provided to you only to review.
Some parts of a site, such as fonts, open-source code or images from third parties, belong to others and are used under their own licences. Those licences pass to you with the site, and your use of those parts is subject to their terms.
We may show the finished site, and describe the work we did, in our portfolio. If you would rather we did not, tell us in writing and we will not.
08What we need from you
You are responsible for the information and materials you give us, such as your answers, logos, images and text, being accurate and yours to use. We draft the words on your site from your answers; you are responsible for checking them and for any claims they make about your business once you have approved them.
You are also responsible for your site meeting the legal and regulatory requirements that apply to your business, including any privacy or cookie notice your site needs. We do not give legal advice.
You agree to compensate us for any claims, losses or costs we incur because materials you supplied, or content you approved, infringe someone else’s rights or break the law.
09After handover
Once your site has been handed over, it is yours to run. Our work on the project is complete, and we have no continuing obligation to maintain, update, secure, back up or host it.
Nothing renews with us. Your hosting and domain accounts are between you and those providers, on their own terms and at their own prices. Keep your account details safe: we are not responsible for changes made to your site or accounts by you or anyone else after handover.
If you would like more work done later, ask us. Any further work is agreed and priced separately.
10What we do not promise
We make no promise about how your site will perform for your business, including its position in search results, its traffic, or the enquiries, sales or revenue it brings.
We do not promise that your site, or the third-party services it relies on, will be free of errors or available without interruption.
11Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
Subject to that, we are not liable for any loss of profit, revenue, business, contracts, data or goodwill, or for any indirect or consequential loss, however it arises.
Our total liability to you for a project, whether in contract, tort (including negligence) or otherwise, is limited to the total amount you have paid us for that project.
12Ending a project
You can end a project at any time before you approve the finished site, by telling us in writing. The deposit is returned as set out above.
We can end a project before approval if we are unable to carry it out, by telling you in writing. If we do, the deposit is returned in full.
If a project ends before approval, the work done on it remains ours and is not handed over.
13Confidentiality
We keep the information you share about your business confidential, and use it only to carry out your project. We share it only with the service providers we rely on to do that work, as described in our privacy notice, or where the law requires us to.
14Using this website
The content of this website is general information about our services. We may change it at any time, and we do not promise that it is complete or current at every moment. The terms of your project are those in its written confirmation and in these terms.
Links to other websites, including the sites in our work, are provided for convenience. We are not responsible for their content.
You must not misuse this website or its forms, including by trying to gain unauthorised access, interfering with how it works, or sending automated or unsolicited submissions.
15Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control. If one affects your project, we will tell you and work to the next practical timeline.
16General
We may update these terms from time to time. The version in force when you book a project applies to that project.
If any part of these terms is found to be unenforceable, the rest continues to apply. A failure or delay in enforcing any part of these terms is not a waiver of it. No one other than you and us has any right to enforce these terms.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them.
